The governor was accused of accepting bribes and sentenced 10 years to appeal.

Important witnesses withdraw their confession, which makes the chief executive of CITIC Bank Quanzhou branch bribery suspect.

Qiu Huizu, an important bribery witness, retracted his confession, which made the establishment of bribery Li Yaoguang one of the focuses of the second instance trial. According to surging news reports, the trial lasted for one and a half days, and the presiding judge did not pronouncement the sentence in court.

According to Caixins previous reports, during the first instance of the case, prosecutors charged Li Yaodong with 10 bribery facts amounting to more than 3 million, but Li Yaodong refused to stand the first trial decision, appealed to the Quanzhou Intermediate Court in Fujian Province, and said he had been tortured to extort a confession.

What the hell is going on here?

Accused of bribes exceeding 3 million

Previously, Li Yaodong, the former president of CITIC Bank Quanzhou Branch, was accused of bribing more than 3 million yuan by businessman Qiu Huizu and others during his tenure, and making profits for others in the process of examining and approving related enterprises to apply for loans, renew loans or increase credit lines.

During the first instance, Li admitted to accepting 100,000 yuan in cash, five liquor cards and 10,000 shopping cards respectively in 2014, but denied bribing the remaining 3 million yuan, including 2 million yuan from businessman Qiu Huizu.

Li Yaodong said that 100,000 yuan in cash was held in Qingdao in the autumn of 2014 when Fujian AD Food Co., Ltd. owner Xu Jincen put in the hotel room in the name of the cost of the event. Five liquor cards and 10,000 yuan shopping cards were put in the office by Wang Rongping, the boss of Fujian Mining (Fujian) Co., Ltd. before the Spring Festival in 2014.

The prosecution, taking Li Yaodong as a state functionary, has illegally accepted bribes from others by taking advantage of his position, and has violated the relevant provisions of the Criminal Law for the benefit of others. The facts of the crime are clear, the evidence is true and sufficient, and the criminal responsibility of the crime of accepting bribes should be investigated.

On January 19, 2018, the Nanan Court of First Instance sentenced Li Yaodong to 10 yearsimprisonment and fined him 1 million yuan for bribery. It concluded that Li Yaodong took advantage of his position to accept bribes for more than 3.09 million yuan, for the benefit of others, the amount was especially huge, constituting a bribery crime.

Appealed against the first instance, claiming that he had been extorting confessions by torture.

Li Yaodong appealed against the first instance and appealed to the Quanzhou intermediate peoples Court of Fujian. In his appeal, he said that the first instance decision was made under the circumstances of procedural violation and insufficient evidence. Li Yaodong asked the Quanzhou intermediate peoples court to revoke the original verdict and change the sentence to no crime or to rehear the case.

At the first instance of the Li Yaodong case, the prosecution issued a verdict of the first instance of Qiu Huizus bribery case, which determined that Qiu Huizu paid 2 million yuan to Li Yaodong four times. However, Li Yaodongs defense attorney pointed out that Qiu Huizu had appealed and that the first-instance judgment was an invalid judgment and could not be used as evidence of conviction in Li Yaodongs case.

At the same time, Caixin reported that Li Yaodong had said in his handwritten accusation that he could not rest for nearly 90 hours at the beginning of the investigation, that mental and physical pain was extreme, that investigators were forced to confess by means of family raiding, arresting relatives, expanding the scope of investigation and that the amount of confession was not up to the standard and the leaders were not satisfied with it. I said that I had been in the leadership position for so many years and had taken bribes at least over 10 million. I said that all my possessions did not add up to 10 million. The other side said that at least 5 million would be transferred, and then it dropped to 4 million. The leader was not satisfied and if he did not, he would live under surveillance for more than six months, and so on.

Witnesses confession shows no bribes.

It is worth noting that the largest amount of bribery by Li Yaodong mentioned in the first instance is 2 million yuan, and the briber is Fujian businessman Qiu Huizu.

The confession of Qiu Huizu, the principal briber, made the case full of doubt. In his appeal opinion, Qiu Huizu said that he did not bribe Li Yaodong $2 million. In the second instance, the Quanzhou Intermediate Court held that the facts of Qiu Huizus crime of bribery were unclear and the evidence was insufficient. The original judgment was revoked and retried to the Nanan Court, which has not yet been pronounced. However, the court heard that the Qiu Huizu case was sent back for retrial without affecting the establishment of the allegation. But some lawyers believe that Qiu Huizu denied bribing Li Yaodong, Li Yaodong also denied accepting Qiu Huizus bribery, and there is no other evidence to prove the bribery, the prosecution can not establish the charge. In from October 25 to 26, 2018, the second instance of the Quanzhou intermediate peoples Court opened the court to hear the case. Whether Qiu Huizu bribe Li Yaoguang was founded was one of the focuses of court hearing in the second instance. According to surging news reports, the trial lasted for one and a half days, and the presiding judge did not pronouncement the sentence in court.
