Article 1

In order to strengthen the safety management of hospitals in this city, maintain the safety order of hospitals, punish the illegal and criminal acts involving medicine, protect the safety of medical personnel and the public interest, these Provisions are formulated in accordance with relevant laws and regulations and in combination with the actual situation of this city.

Article 2

These Provisions are applicable to the safety and order management of all kinds of hospitals at all levels in the administrative region of this Municipality.

Article 3

The safety and order management of hospitals in this city should follow the principles of prevention first, comprehensive management, medical police linkage, disposal according to law and common maintenance.

Article 4

Hospital practice place is a public place to provide medical and health services. No organization or individual may disturb its security order.

The performance of duties of medical personnel shall be protected by law. No organization or individual may threaten or endanger the personal safety of medical personnel or infringe upon their personal dignity.

Article 5

The municipal and District Peoples governments shall strengthen the leadership over the management of hospital safety and order in their respective administrative areas, provide guarantee for hospital safety and order, guide and supervise the health and public security organs and other departments to perform their duties in accordance with the law, improve and perfect the information notification of medical complaints and reports, medical dispute mediation and medical police linkage mechanism, and comprehensively solve the relevant problems in hospital safety and order management.

Article 6

The health department shall perform the following duties:

uff081uff09 Improve medical and health service measures, improve the quality of medical services, guide and supervise hospitals to prevent and properly handle medical disputes;

uff082uff09 To establish and perfect the evaluation mechanism of hospital safety order management and carry out the inspection of hospital safety order management;

uff083uff09 Guide and supervise the hospital to formulate security and risk management systems and emergency plans, and carry out safety education and training and emergency response drills;

uff084uff09 Work with relevant departments to deal with medical complaints and reports in a timely manner, organize and guide hospitals to deal with major medical safety incidents, and release information in a timely manner.

Article 7

The public security organ shall perform the following duties:

uff081uff09 To guide the hospital to formulate internal security system and urge the hospital to implement security measures;

uff082uff09 To inspect and guide the construction and safety inspection of civil air defense, physical defense and technical defense;

uff083uff09 Organize and carry out daily patrol prevention and control of the hospital, and send out the police in time to deal with the illegal and criminal acts related to the hospital, and punish them according to law.

The municipal public security organ shall, together with the municipal health department, formulate and publish the list of prohibited and restricted articles carried by the hospital.

Article 8

The sponsor of a hospital shall perform the following duties:

uff081uff09 We should strengthen the investment in the construction of hospital safety and prevention facilities, provide necessary guarantee for the management of hospital safety and order, supervise and inspect the implementation of safety management measures in hospitals, and eliminate and reduce the hidden dangers of hospital safety and order;

uff082uff09 Supervise and urge the hospital to carry out safety education and training, and improve the ability of emergency response and risk prevention;

uff083uff09 Assist relevant departments in handling major medical safety incidents.

Article 9

The hospital shall perform the following duties:

uff081uff09 Promote real name and non emergency appointment registration, improve the diagnosis and treatment environment, enhance the experience of medical treatment, and improve the quality of medical service;

uff082uff09 Establish and improve the hospital safety management system, improve the hierarchical treatment mechanism and plan for medical safety incidents, and organize emergency response drills;

uff083uff09 To establish the security system of medical personnel, strengthen the education, training and management of medical personnel, improve the professional ethics, professional quality and medical service level of medical personnel, and enhance their own awareness and ability of security;

uff084uff09 Establish a risk assessment system for medical disputes, regularly analyze medical disputes, prevent, reduce and properly resolve medical disputes;

uff085uff09 Make clear the special organization of public security and organize the maintenance of daily safety and order;

uff086uff09 In case of any medical safety incident, the emergency plan shall be launched immediately and emergency disposal shall be carried out quickly.

Article 10

The municipal and district health departments and public security organs, hospitals and local public security police stations shall establish a joint meeting system, discuss and report information, analyze the public security situation of the hospital, carry out investigation and mediation of conflicts and disputes, carry out risk assessment and early warning, and coordinate the handling of medical safety related incidents.

Article 11

The health department, together with the public security organ and other units, has established the security information platform of the whole citys hospitals, sharing the information of medical disputes, high-risk medical personnel, 110 medical police cases and the data of the criminal offenders in medical cases.

Article 12

The public security organ shall intervene in advance in medical disputes and other hidden dangers related to medical safety that may cause public security or criminal cases, carry out prevention and treatment, give legal education to the parties concerned, and warn the consequences of acts.

Article 13

The public security organ shall, in accordance with the regulations, set up a police office in a hospital at or above the second level, equipped with necessary police forces; the police office shall work jointly with the Public Security Department of the hospital. The hospital shall provide necessary working conditions for the police office.

The police in the police office shall strengthen the inspection and guidance of the daily security work of the hospital, urge the hospital to do a good job in the construction of the security system, and carry out patrol, prevention and control, and disposal work.

For a hospital without a police office, the local public security police station and the Public Security Department of the hospital shall establish a daily working mechanism and implement the security responsibilities.

Article 14

The hospital should establish and improve the complaint reception system, standardize the complaint handling procedures, do a good job in propaganda and guidance, and guide the complainants to solve disputes through consultation, mediation, litigation and other legal ways.

In case of medical disputes, the mediation Department of doctor-patient relationship of the hospital shall immediately send personnel to communicate with the patients or their close relatives, and actively resolve the disputes; in case of potential public security or criminal cases, the person in charge of the hospital shall promptly intervene in the handling.

Article 15

According to the scale of the hospital, the number of beds, the daily average number of outpatient services and other actual conditions, the hospital shall provide full-time security personnel and corresponding devices and equipment in accordance with the specified standards, carry out safety patrol in outpatient and inpatient departments and other areas, and be on duty in emergency and other key areas for 24 hours.

Article 16

The hospital shall establish and improve the safety prevention system, equip safety protection equipment and monitoring equipment according to the specified standards, set up safety monitoring center, and implement the full coverage of video monitoring in the main channels and key areas of the hospital.

The hospital shall be equipped with a key alarm device in the emergency room, diagnosis and treatment department, doctors office, nurse station, security checkpoint and other key parts, which shall be connected with the safety monitoring center and police office, and connected to the local public security police station.

When the medical staff triggers the one button alarm device, the police and the hospital security personnel shall immediately go to the scene to verify the situation, resolutely stop the illegal act and take the illegal person away from the scene.

Article 17

The hospital shall establish a safety inspection system, conduct safety inspection at the entrance of the hospital or the entrance of key areas as required, and strictly prevent prohibited articles from entering the hospital; the hospital shall set up a green channel for safety inspection for patients in urgent need.

The hospital shall select a security service company with security inspection qualification to carry out security inspection; the security inspectors shall have security inspection skills and obtain corresponding qualification certificates according to law before taking up their posts.

Article 18

The personnel entering the hospital shall take the initiative to accept and cooperate with the safety inspection; if it is not suitable to accept the equipment safety inspection due to physical or other special reasons, it shall accept the manual inspection. Manual inspection shall protect the privacy of the inspected personnel; manual inspection of female personnel shall be conducted by female security inspectors.

If the hospital refuses to accept the safety inspection, it has the right to refuse its entry; if it refuses to accept the safety inspection and forcibly enters or disturbs the order of the safety inspection site, the safety inspectors shall stop it; if the stop is invalid, it shall be reported to the public security organ for handling according to law.

If the safety inspectors find that they are carrying the articles prohibited by the state, they shall first control the scene and immediately report to the public security organ; if they find that they are carrying the articles restricted by this Municipality, they shall inform them to deposit; if they refuse to deposit and forcibly enter the hospital, they shall report to the public security organ for handling according to law.

Article 19

Public security organs or hospitals may, in accordance with law, impose protective restraint measures or protective medical measures on the medical personnel who threaten the personal, property or public safety of others and disturb the safety and order of the hospital, such as those who are drunk, drug addicted or mentally disabled.

Article 20

If it is found that there is a threat of violence, unreasonable disturbance in the hospital for many times, or high-risk medical personnel such as drunk, drug addicts, mental disorders, etc., the hospital shall give risk prompt to the relevant medical personnel, arrange the security personnel of the hospital to accompany them until they leave the hospital; if necessary, the relevant medical personnel can be arranged to avoid diagnosis and treatment, and report to the public security organ, which shall The provisions of Article 12 shall be stipulated for prevention and disposal.

Article 21

The public security personnel of the hospital shall timely stop the abuse, threat, intimidation and other acts against the medical personnel; if the circumstances are serious, the offender shall be warned to leave the scene and reported to the public security organ for handling according to law.

In the event of a threat of violence against medical personnel, the security personnel of the hospital shall promptly control the violator, immediately report to the public security organ, take effective measures to prevent the situation from expanding, retain fixed evidence, and cooperate with the public security organ in case investigation and investigation.

Article 22

When medical personnels personal safety is threatened by violence, they can take protective measures such as avoiding danger and defense, and suspend diagnosis and treatment; the Department where medical personnel work should immediately start the emergency response plan, report to the public security organ, and protect the safety of medical personnel and medical personnel.

After the situation threatening personal safety disappears, the hospital shall arrange medical personnel to resume diagnosis and treatment in time.

Article 23

No one shall:

uff081uff09 Insulting, intimidating, threatening, abusing, pushing and maliciously following the medical staff;

uff082uff09 Beating or injuring medical personnel;

uff083uff09 Illegally restricting the personal freedom of medical personnel;

uff084uff09 Illegally bring guns, ammunition, daggers and other control devices, explosive, toxic, radioactive and corrosive substances, as well as kitchen knives, axes, sticks and other prohibited substances into the hospital;

uff085uff09 Illegally occupying or deliberately damaging hospital property;

uff086uff09 Loud and noisy in the hospital, deliberately expanding the situation through medical disputes, extortion, illegal morgues in and around the hospital, setting up a spiritual hall, placing wreaths, blocking channels, gathering people to cause trouble, etc;

uff087uff09 Other acts infringing the safety of medical personnel and disturbing the safety and order of the hospital.

Article 24

If a violation of the second paragraph of Article 18 or Article 23 of these Provisions constitutes a violation of public security administration, the public security organ shall, in accordance with the law of the peoples Republic of China on administrative penalties for public security, impose such penalties as warning, fine, detention, etc.

Whoever, in violation of the provisions of the third paragraph of Article 18 of these regulations, brings with him articles which are restricted to be carried into a hospital by this Municipality and does not listen to the dissuasion shall be given a warning or fined not more than 200 yuan by the public security organ.

Those who violate the provisions of Articles 18 and 23 of these provisions and cause personal and property damage shall bear civil liability according to law; those who constitute a crime shall be investigated for criminal liability according to law.

If an illegal act is committed against a hospital or medical personnel, the public security organ shall, according to law, impose a heavier punishment on the offender in any of the following circumstances:

uff083uff09 Having been punished by the administration of public security within six months.

Article 26

For those who seriously endanger the safety and order of the hospital, the relevant units and departments shall, in accordance with the relevant provisions of the state, share the information about their administrative detention and criminal responsibility investigated by the judicial organs to the national credit information sharing platform, and take joint disciplinary measures.

Article 27

If the public security personnel of the hospital cause damage to the wrongdoer due to the normal performance of their duties and meet the legal exemption conditions, they shall not be liable according to law.

If other persons stop illegal and criminal acts and meet the conditions for doing good deeds, they shall be determined in accordance with the relevant provisions.

Article 28

If the hospital fails to perform its duties of safety and order management and there are hidden dangers in safety work, the public security organ shall order it to make corrections and give a warning; if it fails to make corrections within the time limit, it shall be punished according to law, and relevant organizations may be suggested to give punishment to the main person in charge of the unit and other persons directly responsible according to law; if a crime is constituted, it shall be investigated for criminal responsibility according to law.

Article 29

In the management of hospital safety and order, the staff of health and public security organs and other relevant departments who neglect their duties, engage in malpractices for selfish ends and abuse their power shall be given administrative sanctions according to law; if a crime is constituted, they shall be investigated for criminal responsibility according to law.

Article 30

The safety and order management of other medical and health institutions shall be implemented with reference to these provisions.

Article 31

These Provisions shall come into force as of July 1, 2020.
