At the same time, Aomei introduced Guangzhou Fangxing Real Estate Construction Co., Ltd. (hereinafter referred to as Fangxing company) and its subsidiary Guangzhou Fuding Industry Co., Ltd. (hereinafter referred to as Fuding) to cooperate in the development and help solve the capital problem. All parties of the cooperation plan to use the temporarily undeveloped land of 100000 square meters near Guangshan road for the construction of the project start-up area, and plan to build more than 300000 square meters of residential buildings and related commercial supporting facilities. Fangxing company agreed at that time to use the housing resources and return funds of the project for rolling development.
In 2015, the land resources and Planning Bureau of Guangzhou Development Zone and Huangpu District reviewed the comprehensive and detailed planning scheme for the reconstruction of Australian mountain villa jointly submitted by the two development units, namely, Aomei and Fangxing (Fuding). In response to the letter of SGP  No. 140, the relevant control indicators and public construction supporting facilities of the community were implemented.
After the governments vigorous promotion, many interested enterprises have come to discuss cooperation with Australian and American companies. Finally, Australian and American companies chose Ping An real estate. The two sides also signed an agreement of intent, with an estimated total investment of 2.2 billion yuan, but there is no following.
Hu Yaozhi said that Ping An, as a listed company, has strict requirements in terms of finance, assets and other aspects. The debt and creditors rights and other issues involved in the Australian villa are more complex, so the two sides did not reach cooperation at last.
In March 2016, the land resources and Planning Bureau of the development zone and Huangpu District, together with the representatives of the two development units and the owners, held a coordination meeting on the historical problems of the villa project in Australia. But block 017 soon changed from a turning point to a new trouble. According to the notice to owners issued by Aomei company and Hu Yaozhi, Hu Yaozhi raised all the construction funds of plot 017 in his own name and completed the land leveling. However, when Hu Yaozhi applied to the competent planning department for construction in May 2016, he was informed by the court that the land use right of plot 017 would be forcibly transferred by the court to Fangxing company and Fuding company.
The road of reconstruction beyond expectation
Why is the land use right of plot 017 transferred to Fangxing company and Fuding company by the court? Hu said he was cheated by Wu Kaiming, the legal representative of Fangxing company and a former shareholder of Aomei company.
In August 2016, Hu Yaozhi stated in the notice to the owner that, due to the troubles of many lawsuits faced by the Australian and American companies from 2000 to 2004, Hu and Wu Kaiming fabricated the fact that the principal of the loan was 13 million yuan in order to transfer the companys assets and avoid debts, and reached an agreement to repay the debt with the property involved.
In December 2004, Aomei company and Fangxing company signed a transfer contract to transfer four plots under the name of Aomei company to Fangxing company by arbitration, including plot 017, with a total transaction price of more than 100 million yuan.
Aomei said that Fangxing had promised not to transfer the ownership of plot 017 temporarily, and the transaction price of the other three plots was far lower than the market price at that time. However, on July 5, 2016, the peoples Court of Huangpu District, Guangzhou (hereinafter referred to as the Huangpu District Court) issued a notice of assistance in the execution, which transferred the execution of the involved land use right to Fangxing company and Fuding company.
This led to the collapse of the reconstruction of the Australian villa. In August 2016, the land resources and Planning Bureau of Guangzhou Development Zone and Huangpu District stated in the reply to reflect the opinions on the reconstruction of Australias mountain villa that according to the judicial documents of Huangpu District Court, Aomei company has lost the land use right of plot 017 in the reconstruction start-up area, and has no legal and factual basis for the subject qualification of the land development and construction application. The subject of application for construction in the start-up area can only be finally determined after the completion of the execution procedure for the transfer of the right to use lot 017.
Subsequently, Aomei plans to take plot 021 under its name as the priority land for the owner to be resettled, and on January 9, 2018, it applied to Huangpu District Planning Bureau of Guangzhou City for the construction of the application receipt of filing application of Huangpu District land resources and Planning Bureau of Guangzhou city.
However, the plot is in a state of seizure. In order to unseal the plot, auspicious and American companies have repeatedly asked the Huangpu District Court to perform the relevant debts, but the court has not replied. The application for construction is still under examination and approval. As long as Fangxing company receives the execution payment, the four sealed up land will be unsealed immediately, and Aomei company can break the ground and start the construction.
Theres more to the trouble. On August 12, 2019, Fangxing company applied to the court for bankruptcy liquidation of the company on the grounds of insolvency and obvious lack of solvency. Once it is liquidated, the owners will be far away from getting the house back. (bankruptcy liquidation) will damage the legitimate interests of 2348 Australian villa owners. Hu Yaozhi said.
However, on December 6, 2019, Guangzhou intermediate peoples Court of Guangdong Province ruled that the evidence provided by Fangxing company could not prove the debt amount of Aomei company. Fangxing company said that Aomei company obviously lacks the basis of solvency and has no legal reason for bankruptcy.
