The court of arbitration for international sports agreed with the proceedings brought by the International Anti Doping Agency (WADA) against Sun Yang and fina. As a result, Sun Yang (the athlete) was sentenced to eight years suspension from the date of the CAS judgment.

In September 2018, a controversial anti doping test took place in Sun Yangs residence, which failed to be completed successfully. This issue was initially reflected in the finadp, which considered that the Anti Doping code of conduct adopted by Wada, international standards for testing and investigation (ISTI), was not well followed by the tested personnel. Therefore, finadp determined that the acquisition was not effective. Fina hereby determined that Sun Yangs actions did not constitute a violation of the Anti Doping regulations.

Wada appealed the decision to CAS, claiming that Sun Yang deliberately refused to provide samples and requested that Sun Yang be punished with a suspension of at least two years and at most eight years.

The arbitration on this appeal is conducted by a committee composed of CAS judges, including Franco Frattini (Italy), romano-f-sotto (Belgium, UK) and Philippe sanders (UK). The hearing will be held on November 15, 2019. On the application of the parties, the hearing is open to the public.

Considering that in June 2014, athletes were convicted of the first violation of the Anti Doping regulations (ADRV), according to fina Anti Doping regulation 10.7.1, athletes were sentenced by CAS to an eight year ban for the second violation of the Anti Doping regulations, which will be implemented from now on. Considering that: (1) fina did not impose a temporary suspension on Sun Yang when suing him; (2) the doping test results conducted in a short period of time around September 2018 were negative; (3) there was no evidence that after September 4, 2018 (including during the world championships in Guangzhou, South Korea in July 2019), the athletes took doping, and the results achieved by the athletes before the CAS judgment will be Will not be deprived. Unless a party believes that the arbitration decision should be kept confidential, it will be published on the official website of CAS within a few days.
