Man rescues to do CPR to break the old womans ribs

A drugstore owner in Kangping County, Shenyang, resuscitated the woman who came to buy medicine but had a cardiac arrest. When the old lady woke up and was admitted to the hospital, she found that 12 ribs were crushed and the right lung was bruised. Instead, she sued the drugstore owner and asked for nearly ten thousand yuan of compensation for medical expenses, transportation expenses, in-hospital food allowance, etc., and said that the amount of compensation should be added after the disability rating.

Recently, the peoples Court of Kangping County, Liaoning Province made a judgment on the civil case in September 2017.

After investigation, the court found that at around 8:00 on September 7, 2017, the 72 year old plaintiff went to the drugstore operated by the defendant to buy medicine because of dizziness. The defendant suggested that the plaintiff take nitroglycerin tablets and gave one to the plaintiff. Then the plaintiff suddenly had a cardiac arrest. The defendant rescued the plaintiff with cardiopulmonary resuscitation. After the plaintiff regained consciousness, 120 ambulance sent it to the hospital for treatment. The plaintiff was diagnosed For bilateral multiple rib fractures, right lung contusion, hypokalemia, a total of 18 days in hospital, medical expenses 6010.64 yuan, new rural cooperative medical reimbursement of 5619.98 yuan, 390.66 yuan at ones own expense.

The court held that the plaintiff could not provide evidence to prove the relationship between the elderlys cardiac arrest and the nitroglycerin drug provided by the drugstore owner.

Therefore, the court concluded that the rib fracture and lung contusion caused by cardiopulmonary resuscitation for the elderly by the drugstore owner could not be completely avoided, there was no fault in the rescue behavior, no violation of the diagnosis and treatment norms, and no civil liability for the damage caused by the elderly.

Surging journalists noted that the elderly found hypokalemia after hospitalization, can cause cardiac system disorders, serious people can occur heart failure, that is, the heart can not work effectively.

In addition, CPR currently used in China is based on the guidelines for CPR and cardiovascular first aid issued by the American Heart Association (AHA).

According to the guideline, the depth of external chest compressions should be 5-6cm, and the most appropriate rate is 100-120 times per minute. Once the patients heart stops suddenly, the whole body organs that lose the aerobic blood supply will be damaged in succession, especially the brain which is very sensitive to the blood supply. Generally, after 4 minutes of the sudden stop, the patient may have brain edema, and at 6 minutes, the brain cells begin to die. That is to say, cardiopulmonary resuscitation is a race against death. The faster rescue, the less influence on brain function.

On January 2, 2020, sun Xiangbo, the defendant of this case, received a surging news interview. He is 43 years old this year. He is from Kangping County, Shenyang. He obtained medical qualification more than ten years ago. He said that he thanked the court for its fair judgment and the law for encouraging the whole society to act bravely and dare to save people, so as to avoid life passing by because of dare not to save.

[talk to sun Xiangbo

Surging news: do you remember how the old man fell?

Sun Xiangbo: she came to buy a medicine, but I didnt have one. She described her high blood pressure and dizziness. I gave her a blood pressure test and the result was very high. I took her antihypertensive and cardio cerebrovascular drugs, and during that time, she sat on a stool and her head suddenly dropped. I put my hand under her nose. I didnt feel the breath. I didnt feel the pulse. I didnt think of anything, just help.

Surging news: is there anyone else around you when you rescue?

Sun Xiangbo: someone in the drugstore asked for leave that day. I was there to take the shift. I was the only one.

Surging news: how long has cardiopulmonary resuscitation been delayed?

Sun Xiangbo: after about 3 or 5 minutes of doing it in my mind, she reacted. After humming, I felt that this person was alive. Then she became conscious, and I helped her up and sat there. After the rescue, I called 120 and her son.

Surging news: How did you feel at that time?

Sun Xiangbo: Oh, my God, you can save people. If you dont save them, how can you do it? You dont think about anything else. Its like a dream. To be honest, I think Im great.

Surging news: what did the family say after meeting you?

Sun Xiangbo: his son came to see the video at that time. After I watched it for him, he didnt say anything, so he went back. Later, he came again and said that his mother had a broken rib. I said that in order to save people in the rescue process, if the strength and frequency were not enough, she could not live, which was allowed in medicine. He said no compensation. I said you dont thank me. But if you ask me to make compensation, its impossible to say.

In October, I received a phone call from the court saying that I was sued and asked to go to the court for a subpoena.

Surging news: what do you think?

To be honest, from the time of the accident to now, I have always called the aunt of the party concerned, but I havent called the old lady. I have nothing noble, but I just started this business.

Surging news: have you hesitated before rescue? Did you think that might happen?

Sun Xiangbo: at that time, I didnt even think about whether I could save lives. It was just a rescue!

Its completely out of instinct, and its also the first reaction of being a doctor. I didnt think about whether I could save the life. I didnt think about the consequences or anything after the rescue. If I thought about it at that time, maybe I didnt dare to save it.

Surging news: whats the impact on your life after being sued by the people you saved? What do family and friends think of it?

Sun Xiangbo: my parents, including all the family members, only said that they were very aggrieved and didnt say anything else. They didnt say that they shouldnt help or that they were wrong, or that they complained about me. Some people said that they shouldnt have saved him at that time. They just waited for 120 to come, so that they wouldnt do anything. Then they said this from the perspective of arguing for me.

Surging news: according to media reports, your drugstores business has been affected and you have opened another clinic?

Sun Xiangbo: the turnover of drugstores has dropped by more than half, which has a great impact. Before the result of the court came out, the common people didnt understand what was going on. If there was a negative news, others would have ideas and hide. Of course, it cant be put on the whole, and no one blames me for it. Then the drugstore stopped. The clinic has been open for nearly a year. The business is OK.

Surging news: wont clinics be riskier?

(function() {vars = + Math. Domain(). ToString (36). Slice (2); document. Write (< divstyle = id = + S + > < div > ); (window. Slotbydup = window. Slotbydup| []). Push ({ID: u5811557, container: s});))); sun Xiangbo: as long as you are engaged in clinical practice for a day, there will be risks and emergencies, then (because) you chose this industry. Unless you are cruel, even the doctor is wrong. But through this matter, my legal consciousness is stronger. There is no dead space in the place to arrange monitoring video. I feel that as a doctor, I have to think about what I can say now. Surging news: how do you feel now that you have won the lawsuit? Sun Xiangbo: I thank the court for making a fair judgment in accordance with the law, which shows that the rescue behavior is protected by the law. Before the judgment came out, someone around me said that in the future, this kind of thing would not be saved, or it would not only be a lawsuit, but also involve energy and time. So each of us should think about whether we should be exposed, prosecuted or thanked for being saved in the future. If you are ill, do you want 120 to come and save, or is there someone at the scene?
