Li Hongyuan, 42, a former employee of Huawei, was detained for 251 days due to severance damages.
On December 2, Xie Lianxi, a lawyer representing Li Hongyuan and Guangdong yiben law firm, sent a statement to the surging news. The statement mentioned that through communication with Li Hongyuan, it was learned that the so-called letter written by Li Hongyuan to Ren Zhengfei circulated on the Internet at present was not written by Li Hongyuan, and its origin was difficult to be verified.
The statement is stamped with the official seal of the criminal defense team of Guangdong yiben law firm and signed on December 2.
Surging news previously reported that during the resignation of Li Hongyuan, a former employee of Huawei, on December 16, 2018, the head of Huaweis Department reported that he was blackmailed, and Shenzhen Public Security Bureau intervened to detain him. After 251 days, the peoples Procuratorate of Longgang District, Shenzhen City, believed that the facts of the crime were unclear, the evidence was insufficient, and the conditions for prosecution were not met, so it decided not to prosecute Li Hongyuan, and Li Hongyuan was free again.
On the evening of December 2, Li Hongyuan told surging news that the open letter was a patchwork, which was published on the Internet without my consent, and now has had an impact on personal life. The original idea was just to reconcile with the company.
Li Hongyuan also said that at present, the pressure of public opinion is great and he is in a bad mood. Li Hongyuan said that since the follow-up reports from multiple media, some of them are out of control, and the next step is to go back to their hometown.
According to the surging news, Huawei also issued a response to the incident of Li Hongyuan, a former employee, on the evening of December 2, saying that Huawei has the right and obligation to report suspected illegal acts to the judicial authorities based on the facts. We respect the decisions of the judiciary, including public security, procuratorates and courts. If Li Hongyuan thinks his rights and interests have been damaged, we support him to use legal weapons to protect his rights and interests, including suing Huawei. It also embodies the spirit of the rule of law that everyone is equal before the law.
Xie Lianxi said that in terms of the facts of the case, Li Hongyuan really belongs to the statutory innocence. On April 1, he met with Li Hongyuan for the first time and listened to Li Hongyuans statement and explanation. He felt that Li Hongyuan had neither the direct intention of illegal possession nor the act of threat and blackmail subjectively. The compensation for his resignation was not compulsory and was not in conformity with the objective elements of blackmail.

According to the decision on non prosecution made by Longgang District Procuratorate on August 22, 2019 provided by Li Hongyuan, Shenzhen Public Security Bureau transferred the case to Longgang District procuratorate for examination and prosecution on March 21, 2019, and the case went through two return supplementary investigations and one extension of the time limit for examination and prosecution. Longgang District procuratorate finally believed that the criminal facts identified by Shenzhen Public Security Bureau were unclear, the evidence was insufficient, and did not meet the prosecution conditions, so it decided not to prosecute Li Hongyuan.
Li Hongyuans wife said in an interview with surging news that she had not considered whether she would sue Huawei for the time being. This is a long-term thing in the future, which has not been considered for the time being. We still want an apology.
