Local media have different criteria for valiance: it is urgent to introduce the national standard

Questionnaire survey conducted by Zhi Zhenfeng, a researcher at the Law Institute of the Chinese Academy of Social Sciences, led by the research group of Witness to the Righteous shows that there are great differences between the publics understanding of Witness to the Righteous and the local recognition standards. For example, in some places, medical workers can be commended for their bravery and courage when they meet people with sudden diseases and treat them. In this regard, more than 40% of the respondents do not believe that it belongs to the act of righteousness, and less than 60% of the respondents believe that it belongs to the act of righteousness. (Legal Daily, 11 September)

As early as June 1993, the Ministry of Public Security, the Ministry of Propaganda and the Central Committee of Political Science and Law jointly initiated the establishment of the Chinese Foundation for Righteousness and Righteousness. Subsequently, various regions followed up, through recognition, rewards, pensions, condolences, subsidies for the brave people, advocating the brave people and promoting social integrity. However, at the national legal level, there is no clear definition of what kind of acts are acts of courage and righteousness. They are all local tunes. At present, 31 provinces, autonomous regions and municipalities directly under the Central Government have promulgated relevant laws and regulations for the protection of the rights and interests of people who are brave enough to stand up for justice. Because of the inconsistency of local laws and regulations, the same act is often identified differently in different places.

No legal duties, legal obligations or contractual obligations is a prerequisite for many places to recognize the courage of justice. The difference is that the Measures for the Enforcement of Rewards and Guarantees for Persons Who See Righteousness in Guangzhou implemented in April 2015 clearly stipulates that security guards, assistant policemen, security guards, household registration assistants, traffic assistants and other persons with agreed obligations, regardless of their personal safety, bravely fight with criminals or carry out rescue and disaster relief. The act of salvation shall be recognized as an act of righteousness and courage. This means that security guards and criminals are also injured in fighting, which can be recognized as brave acts of justice in Guangdong and possibly not in some other places.

At the same time, different understandings of concepts can easily lead to controversy. In 2016, Chengdu citizen Zhang Mou and Yu Mou were drowned because they rescued their fellow travelers. The authorities refused to recognize the act of being brave and just because rescuing their fellow friends was a special obligation. In response, some legal experts questioned that specific obligations should be limited to legal relief obligations and professional norms, and should not be expanded at will.

On the one hand, it is easy to frustrate the initiative of the volunteers, resulting in their lack of rewards and guarantees, resulting in bleeding and tears. On the other hand, it will also confuse public perception, which is not conducive to promoting the spirit of courage and righteousness. Whether a person with kinship, legal obligation or contractual obligation can be identified as a person who acts bravely for the sake of justice is the main disagreement among the local standards, and the public also has different opinions. Such disputes can easily affect the individuals thinking and behavior. In a critical situation, some people may be afraid to step forward and bring trouble and risk, but they can not be regarded as brave acts for the sake of righteousness.

Considering the different level of local economic development, it is unrealistic to require that the reward criteria for bravery for justice be consistent, but the recognition criteria must be unified and a ruler should be measured to the end. Since 1996, the Ministry of Public Security has initiated the legislative work of taking courageous actions for the sake of righteousness on many occasions. In March 2017, the Draft Regulations on Rewards and Guarantees for Personnel Who Have Been Brave for Righteousness (Draft) solicited public opinions from the society. Now, two and a half years have passed, and the formal law has not been promulgated yet. Admittedly, there are inevitably entanglements between reason and law in the determination of righteousness and bravery. It is not appropriate to set too high or too low a threshold, but this should not be the reason for the stagnation of legislation. Relevant departments should earnestly sum up local practical experience, widely listen to public opinions and suggestions, find the best balance point, formulate and promulgate the National Standard as soon as possible, and better promote the development of the cause of courage for the sake of righteousness.
