Rare! After the Eighteenth National Congress and the Fifth National Congress, such a situation exists in all the tigers

Political circles have noticed that many tigers have already been sentenced after the 18th National Congress, but according to the information disclosed by the court, five tigers are quite special.

Lets start with a message on August 9.

On the same day, the Harbin Intermediate Peoples Court of Heilongjiang Province publicly sentenced Wang Erzhi, former vice-chairman of the CPPCC Jilin Provincial Committee, to accept bribes. Wang Erzhi was sentenced to 14 years for bribery, and he amassed more than 5.72 million yuan. The court said, In view of Wang Erzhis failure to accept 8 million yuan of creditors rights.

Attempt to commit a crime is not common among the tigers sentenced to tiger, but it also exists. According to the statistics of the political knowledgeable monarch, at least five tigers exist.

Failure to succeed for reasons other than will

What is attempted crime?

Criminal law provides for the preparation, attempt and suspension of crimes. Lets take a brief look at the following:

Crime preparation: In order to commit a crime, the preparation of tools and manufacturing conditions is crime preparation. Preparatory offenders may be given lighter or mitigated punishment or exempted from punishment by comparison with accomplished offenders.

Attempt to commit a crime: Attempt to commit a crime has already been initiated. Attempt to commit a crime is a failure due to reasons other than the will of the criminals. An attempted offender may be given a lighter or mitigated punishment than an accomplished offender.

Discontinuation of a crime: In the course of a crime, the suspension of a crime is the automatic abandonment of the crime or the automatic and effective prevention of the consequences of the crime. If the suspension of a crime does not cause damage, it shall be exempted from punishment; if the damage is caused, the punishment shall be mitigated.

Attempt to commit a crime is the cause of failure beyond will, which is different from voluntary abandonment of crime.

However, attempted crime can be punished lightly or mitigated.

Wang Erzhis situation is that from November 2001 to February 2018, Wang Erzhi accumulated more than 5.72 million yuan in various posts, such as the Director-General of the Affairs Management of the Provincial Direct Organs, the Deputy Secretary-General of the Provincial Government, the Secretary-General of the Provincial Political Consultative Conference and the Vice-Chairman of the Provincial Political Consultative Conference.

Wang Erzhis case also had the circumstance of lenient punishment.

According to the court, the lighter punishment in this case is on the one hand due to the attempted acceptance of 8 million yuan of creditors rights, on the other hand, he can truthfully confess his crime when he arrives at the case, voluntarily hand over some facts of accepting bribes that have not been grasped by the case handling organ, and actively refund all stolen money and stolen goods, which has the manifestation of confession and repentance.

Four other tigers

In addition to Wang Erzhi, there are at least four tigers who also have attempted plots. They are:

Zhou Benshun, former Secretary of Hebei Provincial Party Committee

Yu Haiyan, Former Standing Committee and Former Vice Governor of Gansu Provincial Committee

Wei Minzhou, former Standing Committee of Shaanxi Provincial Party Committee and former Secretary of Xian Municipal Party Committee

Li Yihuang, former vice governor of Jiangxi Provincial Peoples Government

Among them, Zhou Benshun was inspected on July 24, 2015. Many people still remember his bulletin. According to the Central Discipline Commission, Zhou Benshun has many problems. The first one is to make speeches against the spirit of the Central Committee on important issues, not to conscientiously implement the main responsibility of building a clean and honest Party conduct, and to interfere with and hinder organizational review.

Nearly two years later, Zhou Benshun was sentenced to 15 years in Xiamen in February 2017.

Zheng Zhijun noticed that Zhou Benshun was also given a lighter punishment.

The court said that in view of Zhou Benshuns attempted acceptance of bribes, he confessed his crime truthfully and voluntarily handed over some facts of the bribery crime that the handling organ had not yet grasped; confessed his guilt and repented, returned the stolen goods actively, and recovered all the stolen money and goods; most of the bribes were received by his family, and Zhou Benshun was informed afterwards and could be lightened according to law. Punishment.

Zhou Benshun was sentenced for more than one year. On July 18, 2018, Yu Haiyan, former standing committee and former vice governor of Gansu Provincial Committee, was sentenced for 15 years in Chongqing.

According to the court, Yu Haiyan amassed more than 65.63 million yuan from 1998 to 2016. Zheng Zhijun noticed that Yu Haiyan also had a circumstance of lenient punishment, one of which was that Yu Haiyans acceptance of Dujianming bribes was partly an attempted crime.

There are 20 million attempted in Weiminzhou and 35.46 million in Li Yihuang.

Wei Minzhou and Li Yihuang also have attempted plots, and the official disclosure of specific figures.

On November 20, 2018, the Intermediate Peoples Court of Chenzhou City, Hunan Province publicly sentenced Wei Minzhou to bribery. Wei Minzhou was sentenced to life imprisonment, deprivation of political rights for life, and confiscation of all personal property.

Zheng Zhijun noticed that Wei Minzhou had accumulated more than 100 million yuan of wealth from 1996 to 2017. In this case, Wei Minzhou also had the circumstances of heavier punishment and lighter punishment.

First, the circumstances of heavier punishment.

Before the case, Wei Minzhou colluded with others to destroy part of the proceeds of bribery and suffered especially heavy losses to the interests of the state and the people, which should be heavily punished according to law.

Secondly, the circumstances of lenient punishment.

In view of the fact that 20 million yuan of Wei Minzhous bribery crime belongs to attempted bribery

To confess ones crime truthfully after a case has a frank plot, to voluntarily hand over most of the bribery facts that the case handling organ has not yet grasped, to confess guilt and repent, to actively refund all the stolen money and stolen goods, and to report, expose and provide clues to other peoples crimes at the stage of investigation. Part of the investigation proves to be true, constitutes meritorious service and has statutory and discretion. If the circumstances of a lighter punishment are determined, the punishment may be lighter according to law.

In the case of Wei Minzhou, 20 million yuan belonged to attempted bribery, while Li Yihuang, former vice governor of Jiangxi Province, had a higher number of attempted wealth-gathering.

On January 29 this year, Li Yihuang, former vice governor of Jiangxi Province, was sentenced to 18 years in Anqing Intermediate Court of Anhui Province. The court found that:

From 2004 to 2017, the defendant, Li Yihuang, took advantage of his position as general manager and chairman of Jiangxi Copper Group Company, general manager and chairman of Jiangxi Copper Co., Ltd. and vice-governor of Jiangxi Provincial Peoples Government, to cooperate with relevant units and individuals in business operation, share transfer, project contracting and job adjustment, etc. The above-mentioned units and individuals illegally received property directly or through others, amounting to more than 51.19 million yuan, of which more than 35.46 million yuan was unsuccessful.
