Deceive to be an active serviceman after retirement

Jiang Hexian, a 31-year-old man from Fule Town, Luoping County, Qujing City, Yunnan Province, was found to have an ID card number of 53032419880513XXXX. In 2017, Jiang Hexian retired from the army and lived idly at home, driven by vanity, often lied to his comrades-in-arms and friends about his work in the Yunnan Discipline Commission; on June 22, 2018, Jiang Hexian lied about himself as the Secretary of the Yunnan Discipline Commission Office, boasting that he could transfer work for others and wanted to move to a public official in Luoping County. On September 10, 2018, Jiang He was invited as a veteran to participate in the ideological education activities for freshmen enrolled in a school in Qujing City, Yunnan Province, and then lied to the staff in charge of propaganda that he would be assigned to the work of Yunnan Discipline Commission, misleading the school to publish articles on the Internet. Jiang Hexian is the false identity information of public officials of Yunnan Discipline Commission.

According to the circular, during the investigation, the public security organs seized a copy of the Officers Certificate which Jiang Hexian carried with him, and verified that the certificate was a counterfeit Officers Certificate purchased by Jiang Hexian, deputy chief of staff of a military regiment.

Recently, according to the relevant provisions of the Law of the Peoples Republic of China on Administrative Penalties for Public Security, the public security organs have sentenced Jiang He to administrative detention for 10 days and fined Wu Baiyuan.

The consequences of pretending to be a functionary of a state organ are very serious.

The public security organs have warned that the illegal and criminal acts of falsifying, altering or buying and selling the certificates of state organs, which pretend to be staff members of state organs, will be severely punished according to law; if the masses find the above illegal and criminal acts, please call 110 in time.

According to the provisions of Article 51 of the Law of the Peoples Republic of China on Administrative Penalties for Public Security, anyone who pretends to be a functionary of a state organ or cheats in other false identities shall be detained for not less than five days but not more than ten days, and may also be fined not more than 500 yuan; if the circumstances are minor, he shall be detained for not more than five days or fined not more than 500 yuan.

Whoever pretends to be a soldier or policeman to bluff and cheat shall be given a heavier punishment.

According to Article 279 of the Criminal Law of the Peoples Republic of China, anyone who pretends to be a functionary of a state organ to bluff and cheat shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention, public surveillance or deprivation of political rights; if the circumstances are serious, he shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years.
