In December 2015, Qi Tao, an unemployed worker in Huludao City, rented a business car to help others cheat in examinations. Subsequently, he contacted Li Shuyuan, a friend who had been sentenced for illegally obtaining state secrets, to come to Jinzhou to commit a crime together.
After the trial, it was found that on December 26, 2015, the National Masters Unified Examination opened in Jinzhou Modern Service School. In the morning, Qi Tao drove his rented vehicle to Binhe Road on the north side of Jinzhou Modern Service School. He set up radio transmitting equipment and other cheating equipment. Li Shuyuan used the laptop computer provided by Qi Tao to get the answers of postgraduate examination questions through QQ group, and then sent the radio transmitting equipment to an examinee who contacted Qi Tao in advance in the examination room to help him cheat. The two men were captured in the car while the public security organs were patrolling. Through the electronic material evidence examination of the laptop computer seized on the spot by the forensic appraisal center of Jinzhou Public Security Bureau, several documents, software folders and two related QQ numbers were detected.
The court held that Li Shuyuan and Qi Tao used cheating equipment to help others cheat in the national examination prescribed by law. Their actions constituted the crime of organizing examination cheating and were joint crimes, which should be punished according to law. To this end, Li Shuyuan was sentenced to one year and one month of fixed-term imprisonment and a fine of 20,000 yuan, Qi Tao was sentenced to one year of fixed-term imprisonment, one year and six months of probation, and a fine of 20,000 yuan, and criminal tools were confiscated according to law.
