 Feng Lizhi, former deputy director of Fucai Center, was sentenced to 17 yearsimprisonment for cancer


Feng Lizhi, former deputy director of China Welfare Lottery Issuance and Management Center, has been sentenced to 17 yearsimprisonment. According to the court, Feng Lizhi received bribes totaling more than 5.85 million yuan; abuse of power caused the loss of more than 160 million yuan of lottery business fees due to the fiscal surrender, resulting in significant losses to national interests. Reporters learned from Beijing Second Intermediate Court this morning that Feng Lizhi was executed outside prison on March 27 because of advanced cancer.

According to public information, Feng Lizhi was born on November 1, 1960 in Hulan County, Heilongjiang Province. He was a postgraduate student with a masters degree in culture. He was formerly the deputy director of China Welfare Lottery Distribution and Management Center (hereinafter referred to as Zhongfu Lottery Center) and the chairman of Zhongcai Online Technology Co., Ltd. (hereinafter referred to as Zhongcai Online Company), and lived in Changping District, Beijing. The suspect was detained on October 31, 2018 for the crime of accepting bribes and abusing his power. On December 13, the same year, he was granted bail pending trial.

On February 26, 2019, the Second Intermediate Court of Beijing issued a criminal judgment, sentencing the defendant Feng Lizhi to 12 yearsimprisonment for bribery and a fine of 1 million yuan; the defendant Feng Lizhi was sentenced to 6 years imprisonment for abuse of power, and decided to execute a total of 17 yearsimprisonment and a fine of 1 million yuan.

After the verdict, Feng Lizhi did not appeal, and the first instance verdict came into effect. During the execution of the transfer, the defendant Feng Lizhi was found to be ill, and his relatives applied for execution outside prison. After consulting the Beijing Peoples Procuratorate, the Beijing Peoples Procuratorate recommended that the Second Central Court decide to temporarily execute Feng Lizhi as a criminal outside prison. Excluding the date of previous detention, Feng Lizhis term of imprisonment shall expire from 27 March 2019 to 13 February 2036.

After investigation, Feng Lizhi suffered from stage IV of right lung adenocarcinoma, right pleural effusion and cancer pain (moderate to severe), which conformed to the scope of serious illnesses outside prison stipulated in the Provisions on Temporary Execution of Medical Treatment outside prison issued jointly by the Supreme Peoples Court, the Supreme Peoples Procuratorate, the Ministry of Public Security, the Ministry of Justice and the State Health and Family Planning Commission, and could be temporarily executed outside prison.

The above facts are confirmed by the on-the-spot evidence, such as the case diagnosis of criminals (community prisoners) issued by the Changping District Hospital of Beijing, Feng Lizhis social investigation and evaluation report issued by the Changping District Judicial Bureau of Beijing, and the reply letter issued by the Beijing Peoples Procuratorate to the courts temporary execution outside prison to seek opinions.

Accordingly, the Second Intermediate Court, in accordance with the Criminal Procedure Law of the Peoples Republic of China, decided to temporarily execute Feng Lizhi as a criminal outside prison.
