 The first provincial local regulations on real estate registration in China will be implemented


On January 9, this regulation was adopted by the seventh meeting of the 13th Standing Committee of the Peoples Congress of Jiangsu Province.

The term real estate registration as mentioned in the Regulations refers to the act of the real estate registration authority to record the ownership of real property rights and other legal matters in the real estate register according to law, including the first registration, the registration of change, the registration of transfer, the registration of cancellation, the registration of advance notice, the registration of correction, the registration of objection and the registration of sealing up, etc.

The Regulations specify that the following real property rights shall be registered in accordance with the provisions of the State and these Regulations, including:

Ownership of collective land; ownership of buildings and structures such as houses; ownership of forests and trees; contractual management rights of cultivated land, woodland, grassland, waters and beaches; use rights of construction land; use rights of residential land; use rights of sea areas and non-resident islands; easement; mortgage; other real property rights that need to be registered by law.

The peoples governments of cities and counties (cities and districts) with districts shall, in accordance with the principle of convenience to the people, centralize the business of housing transaction and real estate registration so as to realize the integration of housing transaction, tax payment and registration.

According to the regulations, the registration of real estate shall be carried out according to the application of the parties, except as otherwise provided by the State.

The registration of real property shall have the results of the investigation of the register of real property rights. The results of the investigation of the real property rights include the results of the investigation of the real property rights and the measurement of the real property.

When applying for the registration of real estate, if the real estate registration institution has not yet obtained the results of the investigation or the results of the investigation have changed, the applicant shall provide the results of the investigation.

The Regulations clearly stipulate that real estate registration agencies, real estate registration information sharing units and their staff shall keep the real estate registration information confidential. Real estate registration institutions and real estate registration information sharing units shall take necessary measures to ensure information security according to law. No unit or individual may divulge or tamper with relevant information.

The supervisory committee, the peoples court, the peoples procuratorate, the public security organ and the state security organ may inquire and duplicate the registration data of real estate related to the matters investigated and handled according to law. The Regulations mention that if a party commits one of the following acts, which constitutes a violation of public security management, he shall be punished according to law; if he causes losses to others, he shall be liable for compensation according to law; if a crime is constituted, he shall be investigated for criminal responsibility according to law. These actions include: applying for registration by deceptive means such as concealing relevant information, providing false materials and pretending to be others, or inquiring or duplicating registration data; forging or altering the certificate of ownership of real property; divulging registration data and registration information of real property; losing, dismantling, changing, extracting and defaming registration data of the inquirer; taking registration data of real property without authorization from the inquiry site and damaging them.
