Prosecutors allege that in April 2017, Hepburn, 23, raped the woman in an apartment he shared with team-mate Clark in Worcester. While Clark was sleeping in the bathroom, Hepburn entered Clarks room and raped the sleeping woman, but Hepburn did not admit to raping herself. In her testimony, the plaintiffs woman said she mistook Hepburns teammate, Joe Clark, for having a relationship with herself at the time.
A jury of six men and six women was told that the woman had gone out at night before the incident, drank wine, gin, vodka and wild bomb cocktails and had voluntarily had sex with Clark.
On Tuesdays retrial, defense attorney Michelle said the woman who had been sexually assaulted did not remember that she had kissed Hepburn for up to 20 minutes before the relationship took place. The victim told the jury that she kept her eyes closed because she thought she and Clark were in the apartment.
I didnt have sex voluntarily. He raped me, the woman said in court. My eyes never opened. The lawyer then asked, Have you never opened your eyes once in 20 minutes? During the testimony, the woman said she did not remember the details of the first time the police spoke to her. About an hour later, he ran to the street for help. A passer-by saw her in the street and helped her.
