Civil Aviation Administration issued severe penalties: smoking in cockpit for one year

The Civil Aviation Administration issued the Notice on the Comprehensive Prohibition of Smoking in the Cockpit, requiring the full prohibition of smoking in the cockpit to be implemented in advance, and recommending that the aviation departments implement severe penalties. Among them, the Civil Aviation Administration recommended that the aviation department suspend operation for 12 calendar months for crew members who violate smoking regulations in the cockpit for the first time. According to the annual salary of the captain in China is between 700,000 and 1.5 million, the average is about 1 million. Smoking is grounded once for one year, and grounding costs one million a year.

The unsafe incidents caused by aircrew smoking in an airline enterprise last year have attracted the attention of all parties. Civil Aviation Administration (CAA) today (January 19) issued the Notice on the Comprehensive Prohibition of Smoking in the Cockpit, requiring that a revised application be submitted to its Qualification Authority by January 25, 2019 to formulate the provisions on the prohibition of smoking in the cockpit.

In the circular, the Civil Aviation Administration recommended that aviation divisions adopt severe penalties, and pilots who smoke in the cockpit for the first time may face a one-year grounding penalty; co-pilots who do not discourage will be grounded for six months.

Specific recommendations: First, for the first time in the cockpit illegal smoking crew members, the suspension of 12 calendar months punishment; for the second time in the cockpit illegal smoking crew members, the suspension of 36 calendar months punishment. Secondly, if smoking on the plane causes serious consequences, the penalty will be aggravated and recorded in the penalty record of the pilots personal technical files. Third, other flight crew members who fail to dissuade illegal smoking in the cockpit shall be punished by suspension of operation for six calendar months.

Relevant personages of the Civil Aviation Administration said that in order to implement the requirements of comprehensive smoking ban in the cockpit, the aviation companies should do a good job of publicity, guidance and supervision, establish the captains responsibility system and the companys irregular smoking inspection system, and the crew members should jointly supervise and strictly implement the smoking ban regulations. The Bureau will strengthen the conformity check of section 121.597 of the CCA-121-R5, as well as the check of the working style of the flight crew in each operation stage, and strictly investigate and deal with the problems found in the inspection.

Chen Jianguo, a senior pilot, told Beijing Youth Daily that smoking in the cockpit is not prohibited in accordance with existing civil aviation regulations. Although the new version of CCAR121R5 explicitly prohibits smoking, Airlines follow the R5 regulations. Full implementation of the smoking ban can be postponed until December 31, 2019, so before this document is issued, airlines do not have to enforce the cockpit smoking ban in accordance with R5.

According to the new regulations, the maximum penalty power of CAAC is 30,000 yuan.

Chen Jianguo explained that Article 121.597 of CCAR121R5 stipulates that smoking is prohibited: no one may smoke on an aircraft operating in accordance with these rules. However, the penalty is Article 121.763: Violation of the provisions of these rules. (a) If the holder of the certificate commits one of the following acts and the circumstances are minor, the authority may order him to stop the illegal act and impose a warning or a fine of RMB 10,000 yuan or less than RMB 30,000 yuan: (10) failing to effectively manage the personnel, cargo and equipment on board the aircraft in violation of the provisions of Chapter T of these Rules, which poses a threat to the operational safety; (c) failing to comply with the certificate holders manual or management. If the circumstances are minor, the authorities may impose a warning or a fine of not more than 500 yuan but not more than 1000 yuan; if the circumstances are serious, they shall be punished in accordance with relevant laws and regulations.

Why should Airlines be advised to punish pilots?

Chen Jianguo told the Beijing Youth Daily that smoking on the plane was minor, that is to say, the penalty for airlines was 10,000 to 30,000 yuan, while the penalty for individuals was 5,000 to 1,000 yuan. Civil Aviation Administration can only punish pilots for violation of regulations, and only punish pilots for 500 to 1000 yuan, so it will recommend that airlines formulate policies to punish pilots. Smoking grounding once a year, grounding for one year, loss of millions per year, according to the average annual income, the annual salary of domestic pilots ranges from 700 to 1.5 million, taking an average of about 1 million. Its a harsh punishment in history, Chen explained. Its understandable that smoking is grounded once for a year, and grounded for a year costs millions.
