It is reported that Zhang Liankai, born in 1968, was a salesman and accountant in the sixth business department of Beijing Guanghua Times Textile and Garment Co., Ltd. before the incident. The prosecution alleged that from 2010 to 2017, when Zhang Liankai was managing the Departments intention to pay the Commission account to the upstream customers, he decided to divide his 180 million yuan into his other bank accounts and Alipay accounts for personal purchase. The defendant, Zhang Liankai, was sent to the Chaoyang District Supervision Committee of Beijing on June 6, 2018 by the companys Disciplinary Commission staff for filing. According to the evidence in the case, he used more than 1.7 million of them to buy a property in Chaoyang District.

After trial by Chaoyang Court, in view of Zhang Liankais voluntary arrival and truthful confession of criminal facts after the case, he surrendered himself and was willing to accept punishment, and the loss of the victims unit could be compensated by the property in the case. Therefore, the punishment was mitigated according to law. Zhang Liankai was convicted of duty embezzlement in the first trial, sentenced to four yearsimprisonment and continued to recover his criminal proceeds. Later Zhang Liankai believed that the original sentence was too heavy to appeal. In the appeal, the defender maintained that Zhang Liankai, a state-owned enterprise employee, should not be the subject of the crime of occupation.

The court of second instance held that the existing evidence could prove that Zhang Liankai, as an accountant of the company, took advantage of his position to obtain and occupy the funds of his own unit, and his behavior accorded with the constitutive requirements of the crime of occupying duties. The appeal was eventually rejected and the original verdict was upheld. The ruling is final.
