The competent department is responsible for directly administering the application-based rent refund of public housing.
Yesterday, the relevant person in charge of the Municipal Housing and Construction Commission made a policy interpretation of the announcement issued recently on the application-based rent refund, restorative construction and management of public housing directly managed by bungalows in historical and cultural blocks of core districts (hereinafter referred to as the Notice). East and West City cottage directly managed public housing, tenants can voluntarily apply for rent refund, voluntarily vacated directly managed public housing tenants receive monetary compensation, can apply for joint property rights and public rental housing resources provided by the district government. Appropriate rewards may also be given to those who voluntarily move their household registration out of the central urban area.
On May 14, last year, the General Office of Beijing Municipal Government issued and implemented the Opinions on Strengthening the Management of Direct Administration of Public Housing, with a focus on promoting the evacuation and renovation of cottages in historical and cultural blocks in core districts. After this opinion was promulgated, the Municipal Housing Urban and Rural Construction Committee, together with the Dongcheng and Xicheng governments, conducted repeated studies. On January 16 this year, with the approval and consent of the Municipal Government, the three units jointly issued and implemented the Notice on Rent Release, Restorative Construction and Operation Management of Public Housing with Direct Management of Cottage in Historic and Cultural District of the Core District.
According to the Municipal Housing and Construction Commission, the competent authorities designated by the district government are responsible for organizing and implementing the application-based rent-refund of public housing directly managed by bungalows in historic and cultural blocks of the district, delineating restorative construction zones and determining the main body of implementation of the zones.
The main body of implementation is responsible for accepting the application for rent refund of the public housing tenants directly in charge of the film area and carrying out relevant work; for restorative construction of the public housing directly in charge of completing the application-type rent refund in accordance with the protection plan and restorative construction process requirements; and for the operation and management of the housing completing the restorative construction.
If the main body of implementation is directly in charge of the management unit of public housing, the right to operate the housing shall be obtained directly after the application-type rent refund and restorative construction of the directly in charge of public housing have been completed. The main body of implementation is determined by means of open competition. The district government may authorize the operation right to the main body of implementation. The operation management unit and the main body of implementation shall sign an agreement on the authorization of the operation right. The one-time authorization period shall not exceed 50 years.
Housing resettlement can appropriately reduce the share of property rights held by residents
Municipal Housing and Construction Commission interpreted that the Notice clearly defined the management requirements for directional housing placement. First, the overall use of housing resources. Directional resettlement houses are managed according to common property rights, and can also be used as public rental houses. The district authorities are responsible for the overall allocation of housing resources, and designate agent agencies to purchase and hold government shares at the approved prices, and allocate them reasonably to each district. If the main body of implementation is a wholly state-owned enterprise or a wholly state-owned enterprise, with the consent of the district government, it may also purchase the directional housing and hold the government share. The proportion of the share of housing with common property rights held by residents and the government shall be determined by the district authorities in accordance with the measures for the management of housing with common property rights, and shall be submitted to the district government for approval. In principle, the purchase price of the common property right housing is not lower than the purchase price.
Secondly, the Municipal Housing and Construction Commission said that if the rent-refund compensation funds obtained by residents are insufficient to cover the share of property rights in the smallest resettlement housing resources determined by the district government, the share of property rights held by residents can be appropriately reduced and the minimum guarantee can be achieved with the approval of the district government. At the same time, for residents who have long lived in self-built houses, have the citys household registration, and have no formal housing for themselves, spouses and minor children in the city, who voluntarily demolish self-built houses and move their household registration out of the central urban area, they can preferentially rent public rental housing connected with film areas.
In addition, considering that some residents have lived in the courtyard of the old city for a lifetime and are inseparable from their homeland, the district government can consult with this part of the tenants to formulate a policy of encouragement for displacement, and guide the tenants to displace to other courtyards under the overall arrangement of the main body to directly manage public housing, so as to realize the rational use of space resources.
Residents who voluntarily move out of their household registration may be rewarded appropriately
Private housing residents within the historical and cultural blocks of core districts who apply for improvement of housing conditions may choose to purchase targeted housing sources at market valuation prices and enjoy full property rights after monetary compensation. The application for rent refund, restorative construction and management of directly managed public housing outside the historical and cultural blocks of the core area may be carried out with reference to the above notifications.
According to the requirements of the notification, one is to highlight the voluntary application of residents without compulsion; the other is to clarify the compensation standard, which is calculated in principle after deducting the total market value of the rented house from the replacement price. Appropriate rewards may be given to those who voluntarily move their household registration out of the central urban area. Third, effective docking with the housing security policy, the voluntary vacation of the directly managed public housing tenants receive monetary compensation, can apply for the joint property rights and public rental housing resources provided by the district government. Fourth, it emphasizes orderly evacuation, and the district government should scientifically formulate an application-based rent-refund and restorative construction plan in the light of standards and implementation of protection planning, financial budget and supply of housing resources for evacuation.
